Welcome to Stay Viaduct! These Terms and Conditions (“Terms”) govern your use of our website and services for booking short-term accommodations in Auckland’s Viaduct Harbour. By making a booking or using our services, you agree to comply with and be bound by these Terms. Please read them carefully.
1. Definitions
- “Host” refers to Stay Viaduct and its affiliated entities.
- “Guest” refers to any individual or group booking accommodation through Stay Viaduct.
- “Property” refers to the accommodation booked by the Guest.
- “Booking” refers to the reservation made by the Guest for a Property.

3. Booking and Payment
- Reservation: Bookings are confirmed upon receipt of full payment or as per the payment schedule outlined during the booking process.
- Payment Methods: We accept various payment methods, including credit/debit cards, bank transfers, and other approved online payment systems.
- Currency: All payments must be made in New Zealand Dollars (NZD).
4. Cancellation and Refunds
- Cancellation Policy:
- Full Refund: Guests may cancel their booking free of charge up to 5 days before the check-in date.
- Partial Refund: Cancellations made between 5 days before check-in and the day of check-in will receive a 50% refund.
- No Refund: Cancellations made after the day of check-in are non-refundable.
- Refund Process: Refunds will be processed within 3 business days to the original payment method.
- Bond Holds: Security bonds starting from $350 NZD will be held and may take up to 3 business days to be released after check-out, provided no damages or violations of Terms occur.
5. Check-In and Check-Out
- Check-In Time: 3:00 PM
- Check-Out Time: 10:00 AM
- Early/Late Check-In/Check-Out: Subject to availability and may incur additional charges.
- Self Check-In: If applicable, instructions will be provided by a pre arranged time confirmed via your booking platform.
6. Guest Obligations
- Occupancy Limits: Guests must adhere to the maximum occupancy limits specified for each property.
- House Rules: Guests agree to follow all house rules provided at the time of booking.
- Respect Property: Guests must treat the Property with care and respect. Any damages may result in additional charges.
7. House Rules
- No Smoking: Smoking is prohibited inside the Property & Complex.
- No Pets: Pets are not allowed unless specified otherwise.
- Noise Levels: Guests must maintain reasonable noise levels, especially during night hours.
- Parties and Events: Hosting parties or events is not permitted unless explicitly agreed upon in writing.
8. Liability and Insurance
- Property Damage: Guests are responsible for any damage caused during their stay. Stay Viaduct reserves the right to charge for repairs or replacements.
- Personal Liability: Stay Viaduct is not liable for any personal injury, loss, or damage incurred by Guests during their stay.
- Insurance: Guests are encouraged to obtain their own travel insurance to cover any unforeseen events.
9. Security Deposits and Bonds
- Security Deposit: A security deposit starting from $350 NZD is required at the time of booking. This deposit will be refunded within 3 business days after check-out, provided no damages or violations of Terms occur. In the event of damage, the deposit will be used to cover repair costs, and any remaining amount will be refunded.
- Bond: For certain Properties, an additional bond may be required to cover potential damages or additional charges.
10. Termination of Agreement
- Violation of Terms: Stay Viaduct reserves the right to terminate the booking without refund if Guests violate any Terms or house rules.
- Force Majeure: Stay Viaduct is not liable for cancellations or disruptions caused by events beyond our control, such as natural disasters, pandemics, or governmental restrictions.
11. Dispute Resolution
- Negotiation: In the event of a dispute, both parties agree to attempt to resolve the matter through informal negotiation.
- Mediation: If unresolved, disputes may be referred to mediation before pursuing legal action.
- Governing Law: These Terms are governed by and construed in accordance with the laws of New Zealand.

These Terms and any disputes arisingout of or related to them are governed by the laws of New Zealand.
